These Terms and Conditions govern property tax protest services provided by Edison and Madison Analytics Group Inc., doing business as TurboProtest™.

By enrolling a property, creating or using an account, clicking acceptance, submitting information, or otherwise using TurboProtest services, you agree to be bound by these Terms and Conditions.

Section 1

Company identity and acceptance

These Terms and Conditions form a binding agreement between Edison and Madison Analytics Group Inc., doing business as TurboProtest™, and the customer accepting them. These terms apply to access to and use of TurboProtest services, website features, account tools, reports, workflows, communications, and related offerings, except to the extent a separate written agreement expressly controls.

Section 2

Service footprint and multi-state operations

TurboProtest may provide services in Texas and in other states within the United States, directly or through affiliates, contractors, licensed consultants, attorneys, hearing representatives, local partners, or other authorized service providers. Service scope, representation rights, filing methods, deadlines, hearing practices, and eligibility standards may vary by state, county, taxing authority, property type, and local law.

TurboProtest may decline, limit, suspend, or discontinue service in any jurisdiction, market, property category, or situation at its discretion, including where legal, operational, licensing, commercial, or risk conditions make continued service impracticable or undesirable.

Section 3

Scope of services

TurboProtest provides administrative, workflow, technology, data-analysis, and property-tax protest support services. Depending on the property, location, and service model, this may include intake and eligibility review, property-data collection and organization, deadline tracking, filing support, comparable analysis, evidence preparation, coordination with licensed tax consultants, attorneys, or hearing representatives where applicable, and case updates or outcome reporting.

TurboProtest may determine, in its discretion and subject to applicable law, the methods, workflows, technologies, personnel, vendors, contractors, or service providers used to perform the services.

Section 4

No legal, tax, appraisal, or financial advice

Unless TurboProtest expressly enters into a separate written engagement with a licensed professional, TurboProtest does not provide legal, tax, appraisal, accounting, investment, or financial advice. Website content, dashboard information, estimates, marketing materials, and support communications are informational and service-related only and should not be treated as individualized professional advice.

Section 5

Customer eligibility, authority, and accuracy of information

You represent that you own the property or have authority to act for the owner, may legally authorize TurboProtest to provide services, and will provide accurate, current, and complete information. TurboProtest may rely on submitted addresses, account numbers, ownership details, signatures, authorizations, and instructions unless corrected in writing.

You must promptly notify TurboProtest of material changes, including ownership changes, mailing-address changes, exemption changes, representation changes, or any other circumstance that may affect service eligibility or performance.

Section 6

Cooperation requirements

You agree to cooperate reasonably and on time, including by signing authorizations, providing requested records, answering questions, disclosing existing representation, and completing forms required by local rules. TurboProtest is not responsible for missed opportunities, filing issues, reduced savings potential, or promotional ineligibility caused by delay, non-response, refusal to cooperate, or incomplete information.

Section 7

Representation and third-party providers

TurboProtest may perform services directly or through affiliates, analysts, contractors, licensed property tax consultants, attorneys, or other providers. TurboProtest does not guarantee that the same person or firm will handle every matter, every property, or every year. TurboProtest may condition service on required local authorizations, licensure, attorney involvement, or other legal requirements.

Section 8

Prior filings, conflicting representation, and duplicate appointments

You must disclose if another agent, consultant, or attorney has already filed or is authorized for the same property and tax year. TurboProtest may suspend, decline, or terminate service, reject promotions, or charge work-completed fees if duplicate filings, conflicting appointments, transfer issues, or representation disputes interfere with service.

Section 9

Pricing and fee structure

Unless TurboProtest states otherwise in writing, the first enrolled tax year is priced at 20% of verified annual tax savings. The second year and each renewal year are priced at 25% of verified annual tax savings. TurboProtest may also charge or pass through disclosed ancillary fees, third-party costs, optional escalation costs, portfolio pricing, or promotional pricing where applicable.

Fees are due as stated in the applicable pricing terms, invoice, order flow, or account disclosures. Amounts owed for pass-through costs or non-refundable third-party charges may remain payable even if service is later withdrawn, suspended, or terminated.

Section 10

How savings and fees may be calculated

TurboProtest may calculate savings using the reduction in assessed value, taxable value, estimated tax liability, negotiated settlement value, corrected tax roll value, or another metric disclosed in pricing terms. TurboProtest may rely on public tax rates, district data, internal methodologies, historical tax data, assumptions, allocations, or other reasonable methods in calculating savings and TurboProtest fees.

Section 11

Automatic annual renewal and future-year service

TurboProtest is designed as an ongoing annual protest service unless prohibited by law, cancelled in accordance with these terms, declined by TurboProtest, or made unavailable due to ownership changes, nonpayment, legal restrictions, conflicting representation, incomplete updated forms, service-area changes, or other eligibility issues. TurboProtest may require new authorizations, updated disclosures, or refreshed account information at any time.

Section 12

Pricing changes and continued use

TurboProtest may update future-year pricing, ancillary fees, or other service terms on notice. Continued enrollment, continued use, failure to opt out before the next filing cycle, or continued acceptance of services after notice may constitute acceptance of updated pricing and future-year terms to the extent permitted by law.

Section 13

Cancellation and sold-property situations

You may cancel before filing without a TurboProtest service fee unless other pricing terms state otherwise. If cancellation happens after filing, after substantial preparation, or after representative work has begun, applicable administrative, work-completed, representation, or pass-through fees may still apply.

If the property is sold or transferred, you must notify TurboProtest promptly. TurboProtest may waive certain fees in its discretion, but costs already incurred may remain due.

Section 14

Promotions, credits, and referral offers

TurboProtest may offer promotional rates, referral credits, transfer credits, or other limited-time incentives. Unless expressly stated otherwise, promotions are non-cash, may not stack on the same property for the same tax year, may expire, and may be denied, capped, reversed, or discontinued for ineligibility, misuse, error, fraud, or breach of terms. Separate promotional terms may apply and control where specifically stated.

Section 15

Platform use, acceptable conduct, and security

You must keep account credentials secure and may not misuse the website or platform, interfere with systems, upload harmful code, scrape content, reverse engineer the service, misrepresent ownership or authority, or use TurboProtest for unlawful or deceptive activity.

Section 16

Data use and privacy

TurboProtest may collect, use, store, process, analyze, and share data as reasonably necessary to provide services, operate the platform, improve products, support analytics, comply with law, prevent fraud, and work with authorized affiliates and service providers. Personal information is also governed by the applicable Privacy Policy.

Section 17

Intellectual property and trademark notice

TurboProtest™, the TurboProtest name, logos, service marks, branding, workflows, analyses, software, reports, and related materials are proprietary to Edison and Madison Analytics Group Inc. or its licensors. Unauthorized use is prohibited.

Section 18

Disclaimers and no guarantee of outcome

Except where TurboProtest expressly states a specific written promotional benefit, TurboProtest does not guarantee any reduction in value, tax liability, refund amount, exemption approval, hearing result, or other economic outcome. To the fullest extent permitted by law, services, platform tools, analyses, reports, and estimates are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, statutory, or otherwise.

Section 19

Limitation of liability, release, and indemnity

To the maximum extent permitted by law, Edison and Madison Analytics Group Inc., d/b/a TurboProtest™, and their affiliates, founder, shareholders, officers, directors, employees, contractors, consultants, agents, successors, and assigns are not liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising out of or related to the services, promotions, website, filings, disputes, or use of the platform.

You agree to indemnify, defend, and hold those parties harmless for claims arising from inaccurate information, lack of authority, owner disputes, misuse, legal violations, third-party disputes, or breach of these terms.

Section 20

Binding arbitration, class waiver, and jury waiver

Except for qualifying small-claims matters or limited requests for temporary or preliminary injunctive relief, disputes relating to TurboProtest, the services, fees, website, promotions, or these terms must be resolved by final and binding arbitration administered by the American Arbitration Association in Texas. Arbitration must proceed on an individual basis only. Class actions, collective actions, representative actions, coordinated proceedings, and mass claims are waived to the fullest extent permitted by law. Jury trial rights are also waived for disputes not subject to arbitration.

Section 21

Texas law, assignment, force majeure, and changes

These terms are governed by Texas law, except where federal law controls arbitration enforceability or other issues. TurboProtest may assign, delegate, subcontract, or transfer its rights and obligations without customer consent. TurboProtest is not liable for delays or failures caused by events beyond reasonable control, including outages, agency delays, weather, cyber incidents, legal changes, public emergencies, labor interruptions, or third-party failures.

TurboProtest may update these terms prospectively by posting or notice. If any provision is held invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
